How to get a residence permit by marriage with a citizen of Ukraine?

A foreign citizen can obtain a residence permit being married to a citizen of Ukraine.

 

To obtain a residence permit for family reunification in Ukraine, you need to marry or be married to a citizen of Ukraine

To apply for a residence permit by marriage, it does not matter where the marriage was concluded, in Ukraine or abroad.

 

If the marriage was concluded abroad, not in Ukraine, the marriage documents must be legalized so that they can be recognized and used in Ukraine.

 

Let’s consider 2 cases when a foreign citizen arrived and got married in Ukraine, and a case in which a foreigner got married abroad.

 

Marriage concluded in Ukraine

A foreigner came to Ukraine and married a citizen of Ukraine.

After that, he has the right to obtain a residence permit for the purpose of family reunification with a citizen of Ukraine.

 

To do this, he needs to leave the country. Apply to the Embassy of Ukraine to obtain a visa type “D” for the purpose of family reunification.

 

After obtaining a visa, come to Ukraine and submit documents to the Migration Service for a residence permit by marriage.

 

Citizens of 7 countries do not need to obtain a visa: Azerbaijan, Armenia, Belarus, Moldova, Georgia and Uzbekistan.

 

Also, if the marriage was concluded in Ukraine after arrival under the visa-free regime, citizens of these countries can apply for a residence permit without leaving the country.

 

Citizens of the Russian Federation need to cross the border to change the purpose of the trip.

 

After that, they can also apply for a residence permit by marriage in Ukraine.

 

The marriage was concluded not in Ukraine, but abroad

If the marriage was registered abroad, it is necessary to legalize the documents for its recognition on the territory of Ukraine.

 

After that, a foreign citizen needs to submit documents to the Ukrainian Embassy for a visa type “D” by marriage.

 

Arriving with a visa, you can apply for a residence permit in Ukraine.

What documents are needed to obtain a residence permit by marriage?

To apply for a temporary residence permit by marriage with a citizen of Ukraine, the following documents are required:

  • Marriage certificate
  • Original passport of a foreign citizen
  • Translation of a foreigner’s passport document
  • Medical insurance policy for 1 year for a foreigner in Ukraine
  • Original passport of a citizen of Ukraine husband / wife
  • An extract on the place of registration of the husband / wife
  • Tax number of husband/wife

 

When applying documents to the Migration Service, the presence of both spouses – the husband and wife with documents is required.

 

You also need to indicate the contact Ukrainian phone number and the actual address of residence in Ukraine when applying for a residence permit by marriage.

 

Term for obtaining a residence permit by marriage

After applying for a residence permit by marriage, you need to wait 15 working days before making a decision on issuing a temporary residence permit by marriage.

 

As a rule, this is 22-24 calendar days.

 

After the decision is made by the Migration Service to issue a residence permit, you must contact the office where you submitted the documents.

 

A foreign citizen must have an original passport document with him for obtaining a residence permit.
